تنظّم هذه الشروط استعمالك لتطبيق ميزان ولخدماته على الإنترنت (حساب ميزان وميزان السحابي)، التي تقدّمها «قروب التقنية الالكترونية» في ليبيا («نحن»). بتثبيت ميزان أو استعماله فأنت توافق على هذه الشروط وعلى سياسة الخصوصية. إن لم توافق عليها فلا تستعمل التطبيق.
1. ما هو ميزان
ميزان أداة لتسجيل الديون والحسابات الشخصية والدخل والمصروف. يعمل كاملًا على هاتفك دون حساب، وحساب ميزان اختياري يضيف مزايا الباقات.
ميزان ليس مصرفًا ولا محفظة ولا خدمة دفع: لا يحفظ أموالًا ولا ينقلها، ولا يحصّل الديون نيابة عنك. الأرصدة التي يعرضها هي ما تسجّله أنت فقط.
ميزان لا يقدّم نصيحة مالية أو قانونية أو ضريبية. التقارير والمجاميع وأسعار العملات للاطلاع، والأسعار تقريبية وقد تختلف عن سعر السوق الفعلي، فتحقق منها قبل أن تعتمد عليها.
2. من يستعمل ميزان
ميزان لمن بلغ 18 عامًا. إن استعملته لنشاط تجاري فأنت تؤكد أن لك صلاحية ذلك.
3. حساب ميزان
أدخل بيانات صحيحة، واحفظ كلمة مرورك والرموز التي تصلك سرًّا، فأنت مسؤول عمّا يجري في حسابك. إن شككت أن غيرك دخل إليه فغيّر كلمة المرور وأخرج الأجهزة الأخرى من التطبيق وتواصل معنا.
يُنشأ الحساب برقم هاتف تثبت أنه لك، برسالة واتساب منه أو برمز يصله. الحساب شخصي لصاحبه، وقد تحدد باقتك عدد الأجهزة التي تدخل إليه معًا.
قد نطلب منك إثبات أن الحساب لك قبل أي طلب دعم يخصه، مثل استعادة الدخول أو الحذف.
4. بياناتك ومسؤوليتك عنها
ما تسجّله في ميزان ملكك، ويبقى على هاتفك. حفظ نسخة احتياطية مسؤوليتك: إن فقدت هاتفك أو حذفت التطبيق أو استعملت «حذف جميع البيانات» دون نسخة، فلا نستطيع استرجاع شيء.
كلمة سر النسخة الاحتياطية لا نعرفها ولا نستطيع استعادتها، والنسخة لا تُفتح بدونها.
حين تسجّل بيانات أشخاص آخرين (أسماءهم وهواتفهم وديونهم) فأنت مسؤول عن أن يكون لك حق ذلك، وعن استعمالها لحساباتك أنت فقط. رسائل التذكير عبر واتساب ترسلها أنت بنفسك، فلا تستعملها للإزعاج أو التهديد.
5. ميزان السحابي (الباقات)
المزايا: نسخ احتياطية مشفّرة على السيرفر، وأسعار عملات حية، وثيمات مميزة، كما تظهر في شاشة الباقات عند الاشتراك.
المدة: لكل باقة مدة ثابتة تُذكر عند الشراء (الشهرية 30 يومًا، والسنوية 365 يومًا). الباقات لا تتجدد تلقائيًا ولا نخصم منك شيئًا دون طلبك. إن أضفت مدة وباقتك سارية تُضاف بعد نهايتها.
الحصول عليها: بكود تفعيل منّا أو من بائع معتمد لدينا، أو برصيد محفظة ميزان، أو بالدفع الإلكتروني حين يتوفر. الأسعار تُعلن في التطبيق أو عند البائع.
أكواد التفعيل: كل كود يُستعمل مرة واحدة، وصالح حتى التاريخ المذكور معه، ويبطل بعده إن لم يُستعمل. احفظه سرًّا، فلسنا مسؤولين عن كود ضاع أو استعمله غيرك.
التجربة المجانية: قد يحصل الحساب الجديد على تجربة مجانية لمدة 7 أيام مرة واحدة. قد نغيّر عروض التجربة أو نوقفها.
الاسترداد: المبالغ المدفوعة لا تُسترد بعد بدء المدة، إلا عند دفع مكرر أو دفع لم تُفعَّل به الباقة، أو حيث يوجب القانون ذلك.
بعد انتهاء الباقة: تتوقف مزاياها حتى تضيف مدة جديدة. تبقى نسخك على السيرفر متاحة للتنزيل 30 يومًا، ونراسلك قبل حذفها بأسبوع إن كان بريدك مؤكدًا، ثم تُحذف.
الهدايا: قد نمنح مدة أو مزايا إضافية هدية، وتسري عليها هذه الشروط.
التغييرات: قد نغيّر مزايا الباقات أو أسعارها للمدد القادمة، أما المدة التي بدأت فتبقى بما شملته.
6. محفظة ميزان (الرصيد المسبق)
ما هي: رصيد مسبق بالدينار الليبي في حسابك، يُستعمل لشراء خدمات ميزان (الباقات) فقط.
لا يُسحب ولا يُحوَّل: لا يُصرف نقدًا، ولا يُنقل إلى حساب آخر، ولا يُستعمل خارج ميزان. ليس وديعة، ولا تُحسب عليه فوائد أو أرباح.
كروت التعبئة: كل كرت يضيف قيمته إلى المحفظة مرة واحدة، ويُعبّأ حتى التاريخ المذكور معه. احفظ رقمه سرًّا؛ لسنا مسؤولين عن كرت ضاع أو عبّأه غيرك قبل أن تبلغنا. قد نوقف كرتًا لم يُعبّأ بعد إن أُبلغنا بضياعه أو بيعه بطريقة غير مشروعة.
الحد الأعلى: للمحفظة حد أعلى للرصيد يظهر في التطبيق، ولا تُقبل تعبئة تتجاوزه.
الشراء بالرصيد: يُخصم سعر الباقة عند الشراء، وتُضاف مدتها بعد نهاية باقتك السارية إن وُجدت.
الاسترداد: الرصيد لا يُسترد نقدًا. نصحّح الأخطاء، مثل خصم مكرر أو كرت لم تُضف قيمته، في المحفظة نفسها.
مدة الرصيد: رصيد المحفظة لا ينتهي ما دام حسابك قائمًا.
عند حذف الحساب: يُحذف الرصيد المتبقي مع الحساب ولا يُسترد، فاستعمله قبل الحذف.
7. الاستعمال المقبول
لا يجوز لك:
استعمال ميزان في مخالفة القانون أو في احتيال أو غسل أموال.
محاولة الدخول إلى حسابات غيرك أو إلى أنظمتنا دون إذن.
فك التطبيق أو تعديله أو تجاوز حدوده أو حمايته، إلا بقدر ما يسمح به القانون.
إرهاق الخدمة أو إساءة استعمالها بطلبات آلية.
بيع أكواد التفعيل أو توزيعها دون إذن منا.
استعمال ميزان لمضايقة أحد أو تهديده أو الضغط عليه، ومن ذلك رسائل تذكير الديون.
8. الملكية الفكرية
ميزان (التطبيق واسمه وشعاره وتصميمه) ملك «قروب التقنية الالكترونية». نمنحك ترخيصًا شخصيًا غير حصري وغير قابل للنقل، يمكن سحبه، لتثبيت ميزان واستعماله لأغراضك وفق هذه الشروط. الخطوط والمكتبات مفتوحة المصدر في التطبيق تخضع لتراخيصها.
9. التحديثات والنسخ المدعومة
نصدر تحديثات لإصلاح المشاكل وإضافة المزايا، ويخبرك التطبيق حين يتوفر تحديث.
قد نوقف دعم النسخ القديمة. النسخة الخارجة من الدعم قد تتوقف عن العمل حتى تحدّثها، ويبقى بإمكانك حفظ نسخة احتياطية من بياناتك منها.
نزّل ميزان من المصادر التي نعلنها فقط (مثل Google Play أو قنواتنا الرسمية). النسخ من مصادر أخرى قد تكون معدّلة وغير آمنة.
10. خدمات الآخرين
الدخول بحساب جوجل، وواتساب، ومزوّد البريد، ومزوّد الدفع، ومصدر أسعار العملات تخضع لشروط أصحابها، ولسنا مسؤولين عن توفرها أو أدائها.
11. توفر الخدمة
التطبيق يعمل دون إنترنت، أما الخدمات على الإنترنت فقد تنقطع للصيانة أو لأعطال أو لأسباب خارجة عن إرادتنا. نسعى لاستمرارها ولا نضمن أن تعمل دائمًا دون انقطاع أو خطأ.
12. حدود المسؤولية
نقدّم ميزان «كما هو» وبحسب توفره، في الحدود التي يسمح بها القانون.
لسنا مسؤولين عن خسائر سببها ما سجّلته أو لم تسجّله، أو الاعتماد على الأرقام أو الأسعار، أو ضياع البيانات لعدم وجود نسخة أو نسيان كلمة سرها، أو فقدان الجهاز، أو خدمات الآخرين.
لا تتجاوز مسؤوليتنا في كل الأحوال ما دفعته لنا مقابل ميزان السحابي خلال الاثني عشر شهرًا السابقة للمطالبة.
لا يحدّ شيء في هذه الشروط من مسؤولية لا يجيز القانون تحديدها.
13. الإيقاف والإنهاء
تستطيع التوقف عن استعمال ميزان وحذف حسابك متى شئت (حذف الحساب). نطلب قبل الحذف ما يثبت أنك صاحب الحساب (رمز التحقق بخطوتين، أو رمزًا إلى رقمك). تبقى سجلات المعاملات المالية للحساب المحذوف مجهّلة مدة الاحتفاظ (5 سنوات) ثم تُحذف. ولا يستطيع موزّع عليه مبلغ لميزان حذف حسابه بنفسه، بل عبر الدعم.
قد نوقف حسابًا أو نغلقه إن خالف هذه الشروط أو القانون، أو لحماية المستخدمين أو الخدمة، ونبلغك متى أمكن. إن أغلقنا حسابًا دون مخالفة منك نعوّضك عن المدة المتبقية من باقة مدفوعة.
14. القانون المطبّق
تخضع هذه الشروط للقوانين النافذة في ليبيا. تواصل معنا أولًا لحل أي خلاف وديًا، فإن تعذّر فالاختصاص للمحاكم الليبية المختصة.
15. تغيير الشروط
قد نحدّث هذه الشروط. يظهر تاريخ آخر تحديث أعلى الصفحة، ونبلغك داخل التطبيق بأي تغيير مهم. استمرارك في استعمال ميزان بعد التغيير يعني قبوله.
These terms govern your use of the Mizan app and its online services (the Mizan account and Mizan Cloud), provided by Electronics Technology Group in Libya (“we”). By installing or using Mizan you accept these terms and our privacy policy. If you do not accept them, do not use the app.
1. What Mizan is
Mizan is a tool for recording personal debts, accounts, income and expenses. It works fully on your phone without an account; an optional Mizan account adds the plans’ features.
Mizan is not a bank, a wallet or a payment service: it does not hold or move money, and it does not collect debts for you. The balances it shows are only what you record.
Mizan gives no financial, legal or tax advice. Reports, totals and exchange rates are for information; rates are indicative and may differ from the actual market rate, so check them before relying on them.
2. Who may use Mizan
Mizan is for people aged 18 and over. If you use it for a business, you confirm that you are authorised to.
3. Your Mizan account
Give accurate details and keep your password and the codes you receive secret: you are responsible for what happens in your account. If you suspect someone else signed in, change your password, sign the other devices out in the app and contact us.
An account is created with a phone number you prove is yours, by a WhatsApp message from it or a code sent to it. An account is personal to its owner, and your plan may set how many devices can be signed in to it at once.
We may ask you to prove the account is yours before any support request about it, such as recovering access or deletion.
4. Your data and your responsibility
What you record in Mizan is yours, and it stays on your phone. Keeping a backup is your responsibility: if you lose your phone, delete the app or use “Delete all data” without a backup, we cannot recover anything.
We do not know your backup passphrase and cannot recover it, and a backup cannot be opened without it.
When you record other people’s details (their names, phone numbers and debts), you are responsible for having the right to, and for using them only for your own records. Reminders through WhatsApp are sent by you yourself; do not use them to harass or threaten anyone.
5. Mizan Cloud (plans)
Features: encrypted backups on our server, live exchange rates and premium themes, as shown on the plans screen when you subscribe.
Length: each plan has a fixed length stated when you buy it (monthly: 30 days; yearly: 365 days). Plans do not renew automatically and we never charge you without your request. Time added while your plan is running is added after its end.
Getting a plan: with an activation code from us or from a seller we have authorised, with the Mizan Wallet’s credit, or by online payment once available. Prices are shown in the app or by the seller.
Activation codes: each code works once and is valid until the date given with it; an unused code expires after that date. Keep it secret: we are not responsible for a code that is lost or used by someone else.
Free trial: a new account may get a 7-day free trial, once. We may change or end trial offers.
Refunds: amounts paid are not refunded once the period has started, except for a duplicate payment, a payment that did not activate the plan, or where the law requires.
When a plan ends: its features stop until you add more time. Your backups on our server stay available for download for 30 days; we email you a week before they are deleted if your email is confirmed, and then they are deleted.
Gifts: we may give extra time or features as a gift; these terms apply to them too.
Changes: we may change the plans’ features or prices for future periods; a period already started keeps what it included.
6. The Mizan Wallet (prepaid credit)
What it is: a prepaid credit in Libyan dinars in your account, used only to buy Mizan’s services (its plans).
No withdrawal, no transfer: it cannot be paid out in cash, moved to another account or used outside Mizan. It is not a deposit, and it earns no interest or rewards.
Top-up cards: each card adds its value to the wallet once, and can be topped up until the date given with it. Keep its number secret: we are not responsible for a card that is lost or topped up by someone else before you tell us. We may stop a card not yet topped up if we are told it was lost or sold unlawfully.
The limit: the wallet has a maximum balance, shown in the app; a top-up that would pass it is not accepted.
Buying with credit: a plan’s price is taken when you buy it, and its time is added after the end of a plan you already have.
Refunds: credit is not refunded in cash. We correct mistakes, such as a double charge or a card whose value was not added, in the wallet itself.
How long it lasts: wallet credit does not expire while your account exists.
When you delete your account: any credit left is deleted with the account and not refunded, so use it first.
7. Acceptable use
You must not:
use Mizan to break the law, or for fraud or money laundering;
try to access other people’s accounts or our systems without permission;
decompile or modify the app, or get around its limits or protections, except as far as the law allows;
overload or abuse the service with automated requests;
sell or distribute activation codes without our permission;
use Mizan to harass, threaten or pressure anyone, including in debt reminders.
8. Intellectual property
Mizan (the app, its name, logo and design) belongs to Electronics Technology Group. We give you a personal, non-exclusive, non-transferable and revocable licence to install and use Mizan for your own purposes under these terms. The fonts and open-source libraries in the app are covered by their own licences.
9. Updates and supported versions
We release updates to fix problems and add features, and the app tells you when an update is available.
We may stop supporting old versions. A version out of support may stop working until you update it; you can still save a backup of your data from it.
Get Mizan only from the sources we announce (such as Google Play or our official channels). Copies from elsewhere may be modified and unsafe.
10. Other companies’ services
Google sign-in, WhatsApp, the email provider, the payment provider and the exchange-rate source are governed by their owners’ terms, and we are not responsible for their availability or performance.
11. Availability
The app works without the internet, but the online services may be interrupted for maintenance, faults or reasons beyond our control. We work to keep them running and do not guarantee they will always work without interruption or error.
12. Limitation of liability
We provide Mizan “as is” and “as available”, as far as the law allows.
We are not responsible for losses caused by what you recorded or did not record, by relying on the figures or rates, by losing data for lack of a backup or a forgotten passphrase, by losing your device, or by other companies’ services.
In any case, our liability does not exceed what you paid us for Mizan Cloud in the twelve months before the claim.
Nothing in these terms limits a liability that the law does not allow to be limited.
13. Suspension and termination
You can stop using Mizan and delete your account at any time (delete your account). Before deleting, we ask for proof that the account is yours (your two-step PIN, or a code to your number). A deleted account's records of money transactions are kept, anonymised, for the retention period (5 years), then deleted. A distributor who owes Mizan cannot delete their own account; support closes it.
We may suspend or close an account that breaks these terms or the law, or to protect users or the service, and we will tell you when we can. If we close an account without a breach on your part, we will compensate you for the time left on a paid plan.
14. Governing law
These terms are governed by the laws in force in Libya. Please contact us first to settle any dispute amicably; if that fails, the competent Libyan courts have jurisdiction.
15. Changes to these terms
We may update these terms. The date of the last update appears at the top, and we will tell you in the app about any significant change. Continuing to use Mizan after a change means you accept it.
